‘Islam will dominate…’ and ‘kill Gordon Brown’ is NOT religious hate speech

A MUSLIM protester who daubed a war memorial with graffiti glorifying Osama Bin Laden and proclaiming “Islam will dominate the world” walked free from court after prosecutors ruled his actions were not motivated by religion.

Tohseef Shah, 21, could have faced a tougher sentence if the court had accepted that the grafitti  – which included a threat to kill the Prime Minister  – were inspired by religious hatred.

But  -  citing a loophole in the law  -  the Crown Prosecution Service chose not to charge him with that offence and he escaped with only a two-year conditional discharge and an order to pay the council £500 compensation after admitting causing criminal damage.

Yesterday the decision was attacked by politicians and veterans who were shocked by the desecration of the memorial in Burton-upon-Trent, Staffordshire.

According to this report,Tory MP Patrick Mercer, chairman of the Parliamentary Counter Terrorism sub-committee, said:

This is an outrage against our war dead.

Shah sprayed the words “Islam will dominate the world  -  Osama is on his way” and ‘Kill Gordon Brown’ on the plinth of the memorial in December.

He was arrested after his DNA was found on the discarded spray-can but refused to give an explanation for his actions or show any remorse, a court heard.

A file was sent to lawyers at the Counter Terrorism Division of the CPS in London to see if there was a racially or religiously motivated connotation.

However when Shah appeared before magistrates this week, prosecutor Andrew Bodger said:

It was decided there was not enough evidence to prove this, and they decided it was politically motivated.

Defending, Mumtaz Chaudry said Shah did not hold extremist views.

This is nothing to do with his religious beliefs, his family’s beliefs or his cultural beliefs. He is just an ordinary guy. He is remorseful, but at the time of his interview he was simply answering questions and didn’t realise that was the right time to show remorse.

Local veterans reacted with horror last night. Roy Whenman, 78, who fought in the Korean War, said:

If what he wrote on the memorial wasn’t evidence of racial or religious hatred then what is? The memorial commemorates people of my generation who died for our freedom as well as those fighting in wars today.  It’s diabolical that someone could deface it in this way.

Community leaders among Burton- upon-Trent’s 4,000-strong Muslim population also slammed Shah’s actions.

Khadim Thathall, a former president of a mosque in the town, said:

This young man has clearly been radicalised by groups which are looking to cause trouble and it’s a pity that the court hasn’t been able to deal with him more strictly.

Shah  -  believed to be a former student of De Montfort University in Leicester  -  used a photograph of a flaming lion’s head superimposed on crossed Kalashnikov rifles on his Facebook profile which was deactived earlier today.

But the social networking site now has a group demanding that Shah be jailed then deported “to a more suitable country”.

Shah lives with his parents in a £200,000 detached house and works at his father’s car spares shop. Last night, he refused to discuss the case.

Instead he appointed Abdullah Ibn Abbas, who described himself as spiritual leader of a group called Road to Jannah, to speak on his behalf.

He said:

It really doesn’t concern us how the British people feel about the graffiti he wrote  -  the real outrage should be about the thousands of Muslims who are being killed and butchered as a result of British foreign policy.

The CPS said Shah’s offence could not be charged as a hate crime because the law requires that damage must target a particular religious or racial group.

It said:

While it was appreciated that what was sprayed on the memorial may have been perceived by some to be part of a racial or religious incident, no racial or religious group can be shown to have been targeted.

    I’m from a military family. We currently have three serving.
    I don’t expect a cunt like Shah to respect a war memorial, just stay the fuck off it and to keep his fucking mouth closed. This WAS religious hatred, hatred of us infidels and the tools we use to defend ourselves from his kind. He should be made to clean it up himself. Fucking treason, that’s what it is. If he’s got family in (I assume) Pakistan he should fuck off and live with them. I hear the Swat Valley’s nice this time of year. I can also recommend Kajaki in Afghanistan. He’d soon want to come back here to live.

    So how come Harry Taylor, who mocked religion with a broad brush, was charged and found guilty of “religiously aggravated” offenses? Or was his behaviour cut and sliced into offenses against Christianity and offenses against Islam? Perhaps more to the point, Taylor didn’t target any religious group anyway – he targeted their block-headed religions.

I’d like an explanation, though, why an anti-war protester can be nicked, prosecuted and jailed for defacing a statue of Churchill yet this nob head gets off scot free.     This compares interestingly with the sentence handed out to the man at Liverpool Airport. That, it was said, was an attack on religion. This is a religious attack on our war dead and that includes some of my relatives.

    Absolutely outrageous. It shows that English law has placed itself in contempt for that which it alleges to serve, THE LAW of the land. This case is pretty much identical to the Harry Taylor case apart from the clear religious overtones. Yet again the CPS and English legal system bend over backwards to let an extremist off the hook.

    People who do this should be deported as “undesirable aliens” along with their families. And as for the idiot Abbas, he should join them.

    When is this nonsense going to stop and firm action taken to not only deal with what basically the English system has now “encouraged” further such disrespectful action by other silly twats. I can see more and more vandalism of OUR memorials and cultural sites.

    As to us killing thousands of their’s. I am sure they have probably killed far more of their own people than we have. Also if these wankers feel that strongly about it, DO NOT LIVE HERE.     Of course his actions were religiously motivated. Saying a religion will dominate the world is not a political statement, it is a religious one. It seems obvious to me that the law is impotent when it comes to dealing with extremists because of fears that it will ignite tension between (some) Muslim groups and the rest of society.. What other reason could there be? He’s as guilty as sin, but is let walk free.. No doubt laughing about it with his buddies.

    The message is clear: the moderate, temperate and accepting countries will, and are, being imposed on and the convenient tools for this are the “forward thinking, left wing, chattering classes” who fondly imagine that a multi-cultural paradise is on the way. Already, in the UK the policy of appeasement to Islam is scary. They don’t like a book and a Fatwa follows; they don’t have the time to pray six times a day or whatever and they are being discriminated against; little girls are having their clitoris removed and “Community Leaders” must be consulted; they want their religious leaders in the House of Lords and might still acheive this; they do not like certain films they find offensive and they must be removed.

    The really bizarre irony in all this is that Tony Blair backed up by Gordon Brown and the rest actually sent and continue to send UK military to defend “democracy” in muslim countries where the people they are supposedly defending are delighted every time the “defenders” are slaughtered. I think the UK, ever the poodle of the USA, has spent more and provided a greater military presence in Iraq and Afghanistan than any other European Country. In return we get a pat on the head and told that the “special relationship” – an utter phantasy – is very important.

    Padang, West Sumatra (ANTARA News) – A recent study has shown that many westerners have become interested in studying Islam comprehensively to find answers to questions related to nature, an Islamic acedemic said.

    Interest in studying Islam among westerners was increasing because they have come up against social and economic problems, questions of nature, they cannot solve, said Mohammad Siddik MA, director of the International Institute of Islamic Thought (IIT) , here Saturday.

    Speaking on the sidelines of an international seminar themed “Islamic Epistemology and Education Reform”, Siddik said the westerners had come to the realization all the sciences they had been exploring and developing could not be truly understood only with common sense.

    He said a French scientist who had written a book on the Bible and the Koran had admitted that the Koran contained all-embracing knowledge about nature.

    “In fact, many western scientists have therefore converted to Islam,” he said, adding this was proof there was no dichotomy between Islam and science.

    According to Siddik, Islam was now growing fast in the western world. In the United States alone there were now 400 mosques whereas in the past there used to be only one.

    Many Americans had also converted to Islam due to emptiness in their souls, he said.

    And chrsbol, no demographic predication has ever been right. According to demographic predictions of bygone eras, all of North America should now be Chinese, or Irish, or Catholic, or Hispanic. But culture trumps demography. Muslim birth rates are falling into step with European birthrates, especially in Europe, for one reason: urbanization! The Catholic Church tried to engineer the revenge of the cradle in Quebec–and then, one day in 1967, all the churches emptied out. Radical Islam is a fad.     I have to agree with the assessmentment of British policy. By now, if they were really taking their duties seriously, it should be tens, if not hundreds of thousands. You have to get their attention before they hear what you’re saying. Right???

    I’m a peace loving guy, but, there are some people you can’t reach, and as throughout history, you call up the bad boys to put down the idiots.

    Unfortunately, sometimes rich people use bad people to put down good people trying to make an honest living for their families, in the interest of company profits.

    The growing influence of Islam is a real concern for Westerners where we see almost daily news articles of religiosly motivated human rights abuses and murders:

    I’m not intolerant of any religion. It’s when their followers attempt to have an undue influence on our secular society and how I live my life that riles me.

    I doubt you’ll find much racism amongst the contributors here either. Have a look at some previous articles, not just about Islam, and you won’t find much support for Mr Griffin (or is it Blofeld? and his toothbrush-moustache brigade. I thought we were all one race? It’s just that some, culturally or by choice, adhere to behavioural codes suited to the Dark Ages and earlier.

I think that he made many good points regarding racism. The only thing that I would pick him up on is that although Islam does indeed teach respect for other religions, Although with a preference for the Abramic ones, it does also say that you should kill non believers and apostates.

    Without trying to minimise the feelings this has raised, or negate the link between a war memorial and the meaning behind the graffiti, but this is actually the sort of thing that Pat Condell says – “Islam will dominate the world unless we stop the politically correct notions”. Taking that to the absurd: if we don’t kill the weak-minded politicians who kow-tow to the notion that religions are protected, then Islam may just end up ruling.
    I sympathise with the prosecutors: If I spray-painted “catholic priests will always abuse, so brace yourselves” on an orphanage, am I mocking or supporting the catholic church?
    Comparisons to the Harry Taylor case – Not so much. Two wrongs don’t make a right – and such blatant intolerance deserved a penalty. It isn’t as if this young man has gotten off without one. The lad may not want to discuss this ’cause he was drunk or stoned at the time 🙂

    Many people will draw an analogy between the judiciary’s treatment of Shah and that of Taylor, and in doing so will be infuriated by the contrasting differences.

    I accept that Shah is an extreme case and not representative of the majority of moderate Muslims.

Time to seal that ‘loophole’ and get some sanity back into the argument. The loophole has been identified as a problem and must be fixed. As should muslims wishing to emmigrate to the UK, or the west in general.

    I am working abroad at the moment ( no doubt some of you on this forum, will think I should stay there)but I was very annoyed by the actions of this guy – most definitaly he should have got a more stiffer sentence, maybe some community work in an old peoples home or vetrans hospital where the people could recount their experiances, or made to watch the recent episode of South Park over and over!.I as a muslim found it funny. He should as someone said be given the task of cleaning it up at his or his families expense. He is young and very stupid ( This is not an excuse for his behaviour. He should also maybe work abroad in his country of origin, because he can never be truely british – Right? there he will see that people are very less than Islamic some of these countries are very corupt and then maybe he will see that some of the values he has and some of the way that he thinks owes the western democracy – the countries that our parents/grandparents migrated from ( at the request of Britain I might add)have lost the true spirt of Islam and if he went back to Pakistan, assuming thats his ancestral home he would be duped in 2 seconds flat.
    Theres no doubt to me that I love Britain but some of your commets make me wonder. Please people know that not every muslim is NOT a scrounger in recipt of state benefits and seeking to steal your council houses. I am educated to post graduate level pay my taxes, own my home send my child to independent school and do this as a muslim women, yet if I walked past people in the street some of them look at me with disgust. My question to you all is how many muslims do you actually know? I am tired of the comments that they keep themselves to themselves….maybe the first generation of migrants did that, dont we have so called ‘white flight’ now in the UK?. How many muslims do people know that are second or third generation and im not talking about a neighbour that you just say hi to. Statistically a muslim is more likely to know and associate with more none muslims if he wants to. If a guy from Scotland has only ever known other White Scotish people does that mean he is going to be racist..of course not.
    And finally please know that there are muslims working to change this kind of behaviour wether this is done privately or publicly the most important thing is that this change happens.
